Terms of service
These terms are the agreement between you and us for using Mealstone. Please read them together with our privacy notice. If you're a coach, our data processing agreement is part of them too.
The short version
- Mealstone is a tool that coaches and their clients use together. It gives no advice of its own, and it isn't a medical service.
- Coaches are independent professionals. Each coach is responsible for their advice, their content and their clients' data.
- Everyone is responsible for what they add to Mealstone.
- AI helps coaches. A coach checks what AI drafts for them, and is responsible for what they send.
- Clients use Mealstone free. Coaches pay a subscription through the App Store or Google Play.
- You can stop and delete your account at any time.
1. About these terms
Mealstone is provided by MJK APPS SRL, a company registered in Romania (“we”, “us”), whose full details are under Contact, at the end. “Mealstone” means the apps for iPhone and Android, the coaches' web app and our web pages.
By creating an account or using Mealstone, you accept these terms. If you don't accept them, please don't use Mealstone.
Two other documents apply:
- our privacy notice, which explains what happens to your personal data;
- for coaches, our data processing agreement, which covers the clients' data we process for them.
A coach may also have their own collaboration agreement with their clients. That agreement is between the coach and the client, and we aren't a party to it.
These terms are available in English, Romanian and Hungarian. If the versions differ, the version in your language prevails.
2. What Mealstone is, and isn't
Mealstone is a tool for the work between a nutrition coach and their clients: the questionnaire, check-ins, plans, meals, photos, messages, consultations and the coach's library.
- Mealstone gives no advice. Nothing in Mealstone is nutrition, health, medical or psychological advice, a diagnosis or a treatment, and Mealstone isn't a medical device. Everything a client is advised comes from their coach.
- Mealstone isn't a medical service, and it isn't for emergencies. Nobody watches it around the clock. For urgent medical help, call 112. If you have a health condition, are pregnant or breastfeeding, or take medication, talk to your doctor before you change how you eat.
- Coaches are independent. They aren't our employees, agents or partners. We don't check their qualifications, experience or claims. A coach's listing in the directory isn't a recommendation, and choosing a coach is your decision.
- We aren't part of the coaching itself. What a coach provides, and any fees for it, are agreed between the coach and the client, outside Mealstone. We don't handle those payments, and we aren't responsible for the coaching.
3. Your account
- You must be 18 or older to use Mealstone.
- You sign in with Google or Apple. Keep that account secure: you're responsible for what happens in Mealstone under your account. Tell us at once if you think someone else has used it.
- Give accurate information, and keep it up to date. An account is for one person, and you can't pass it on to anyone else.
- Coaches register with a registration code from us or from a coach we've authorised.
- Clients join through a coach's invitation, or by accepting an offer from a coach they asked in the directory.
4. If you're a client
- You decide what to share. Your coach relies on what you tell them, so please be accurate, especially about allergies, health conditions and medications.
- Your consents. Coaching in Mealstone needs your consent to share your health information with your coach. You can change your consents at any time; the privacy notice explains what each one does.
- Your coach. Your coach sees your data while you're connected. Either of you can end coaching at any time, and you keep your data. What your coach can do for you in Mealstone depends on their subscription. Questions about the coaching itself, its conditions, fees or refunds go to your coach.
- Your health. Mealstone doesn't replace your doctor. If something doesn't feel right, stop and get medical advice.
5. If you're a coach
Your coaching
By registering as a coach, you confirm that you're allowed to provide the coaching you offer, where you offer it. You coach your clients as an independent professional, and you're responsible for:
- your advice, plans, feedback, programs, consultations and library items;
- agreeing the terms of your coaching with each client yourself: what you provide, any fees, cancellations and refunds. Your collaboration agreement in Mealstone is one way to do it;
- having the qualifications, and any licence, registration or insurance, that your work requires;
- following the laws and professional rules that apply to you, including consumer and tax law towards your clients;
- referring clients to a doctor when their situation needs one.
Mealstone's checks, such as allergen warnings, risk flags and warning signs, help you notice things. They won't catch everything, and they don't replace your own judgement.
Your clients' data
You're the controller of your clients' personal data under the GDPR, and our data processing agreement sets out how we process it for you. You're responsible for:
- having a lawful basis to coach your clients;
- telling them how you use their data;
- answering their requests about it, which we help you with;
- adding only the personal data you're allowed to use. For example, sample plans you import must not contain anyone else's details.
AI assistance
Mealstone's AI drafts feedback, summaries and replies for you, writes down your clients' voice messages and helps you import your own sample plans. For your clients, it translates your library items into their language, groups a plan's foods for the shopping list, and makes pictures of the meals in your plans. A draft can be wrong, incomplete or unsuitable for a client: for example an amount, an allergen or something that doesn't fit their health condition. A draft isn't professional advice, and AI assistance isn't a medical device: it doesn't diagnose anything.
- Mealstone keeps every text AI drafts for you where only you can see it, until you publish or send it.
- Translations of your library items, the grouping of the shopping list and meal pictures reach your clients without a separate check. A meal picture can arrive after you've published the plan. You can replace a picture with your own.
- Meal pictures are made by AI from the dish's name, or added by our team, and are marked when AI made them. The same dish has the same picture for every coach. Pictures you add yourself stay yours.
- The AI provider may not use your data or your clients' data to train its models.
- Check every draft before you publish or send it, especially amounts and allergens.
- Once you publish or send a text, it's yours, and you're responsible for it.
- You can switch AI assistance off and write everything yourself.
Your listing in the directory
- Your presentation must be accurate and not misleading, and you need the rights to the photos, videos and texts you use. Don't make health claims you can't support.
- Anyone signed in to Mealstone can see your listing. Your phone number, if you give one, shows partly hidden until someone reveals it.
- How coaches are listed: coaches who speak the app's language come first, then everyone in alphabetical order by name, your brand name if you use one. A search narrows the list but never reorders it. Nobody can pay for a better position.
- We may take down a listing that breaks these terms. If we do, we tell you why, and you can ask us to reconsider.
Sharing on social media
Export a client's before-and-after comparison only while they've given their consent. You publish the posts, and you're responsible for them, including hiding the client's face where needed. If the client withdraws their consent, we tell you, and you must take down the posts that use their photos.
Your subscription
- Every coach starts free, with one client. Paid tiers allow more active clients. Pending invitations and open offers count towards your limit.
- You buy and manage your subscription in the App Store or Google Play. Payment, renewal, cancellation and refunds follow the store's rules.
- A subscription is monthly and renews automatically until you cancel it in the store. Deleting your account doesn't cancel it.
- An upgrade applies at once; a downgrade applies at renewal.
- If your paid subscription ends, you go back to the free tier, and you can't invite clients beyond its limit.
- If you have more clients than your plan covers, we may give you 7 days to upgrade or choose who stays. After that, the other clients are paused until you upgrade or make room: you can still message them, see their safety flags and end coaching, but nothing else. You can change who stays freely during those 7 days, and after that once every 30 days.
- We tell you in advance before a price changes. The store asks for your agreement where its rules require it.
Master coaches
If we make you a master coach, you can give registration codes to other coaches. You decide who gets a code, so give codes only to people you'd vouch for.
Claims about your coaching
To the extent the law allows, you'll cover our losses and reasonable costs, including legal fees, if anyone makes a claim against us about:
- your coaching, including any text AI drafted that you published or sent;
- your content;
- your breach of these terms or of the law.
6. Your content
- It stays yours. You keep the rights to what you add to Mealstone: texts, answers, photos, videos and documents.
- What you allow us to do with it. You give us a non-exclusive, royalty-free licence to store, process, transmit and display your content, including through AI features and translation. We use it only to run Mealstone for you and the people you work with, and as our privacy notice describes. The licence ends when the content is deleted, apart from backups, which are gone within 7 days, and copies the law requires us to keep.
- You're responsible for it. Only add content you have the right to add, that is lawful and that is accurate. Don't add other people's personal data unless you're allowed to.
- Reporting illegal content. We don't watch what people add. Our support staff look only to help with a problem someone reports, as the privacy notice explains. You can report a coach's presentation in the app. To report anything else you think is illegal, email support@fluttech.com, saying where it is and why. We review every report and tell you what we decided. We may remove content and suspend accounts that break these terms or the law, and we explain our decision to the person affected.
- Your feedback about the app helps us improve Mealstone, and we may use it freely.
7. Using Mealstone fairly
Don't:
- break the law, or harass, threaten or deceive anyone;
- pretend to be someone else, or use Mealstone for anyone under 18;
- use phone numbers or other details from the directory for anything other than choosing a coach, for example for marketing;
- upload malware, or try to get around our security, our usage limits or other people's access rules;
- copy, scrape, resell or reverse-engineer Mealstone, except where the law allows it;
- use Mealstone to offer emergency or medical services.
8. What belongs to us
Mealstone's software, design, texts and name belong to us or the people we license them from. We give you a personal, non-exclusive, non-transferable licence to use Mealstone for its purpose under these terms. The open-source licences of the software we use are listed in the app.
9. Availability and changes
- We work to keep Mealstone available and secure, but we can't promise it will always be available or free of errors. Most features need an internet connection, and AI assistance may sometimes be unavailable.
- We may change, add or remove features. If a change significantly reduces what a paying coach gets, we tell you in advance, and you can cancel.
10. Ending or suspending an account
- You can delete your account at any time, in the app or by email. Delete your account explains how. Coaches should cancel their subscription in the store first.
- We may suspend or close an account if:
- it seriously or repeatedly breaks these terms or the law;
- the law requires us to;
- we need to, to protect the people who use Mealstone.
- What happens to the data: the privacy notice explains it. When a coach leaves, their clients keep their own data.
11. Responsibility and liability
Nothing in these terms limits or excludes any liability that the law doesn't allow us to limit or exclude. That includes liability for:
- harm we cause deliberately or through gross negligence;
- harm to anyone's life, body or health;
- your rights as a consumer.
To the extent the law allows, we aren't responsible for:
- the coaching, advice, plans or other content a coach provides, or for what follows from them;
- what any coach or client does, or the content they add;
- services run by others, such as Apple, Google, YouTube, WhatsApp or a coach's video call service;
- losses caused by your own breach of these terms;
- events beyond our reasonable control.
If you're a client, Mealstone is free for you. We're responsible only for losses that are a foreseeable result of our breaching these terms or of our fault. To the extent the law allows, our total liability to you is limited to EUR 100. Your rights as a consumer aren't affected.
If you're a coach, you use Mealstone for your business. To the extent the law allows:
- we aren't liable for indirect losses, or for loss of profit, income, clients or reputation;
- our total liability to you in any 12 months is limited to the higher of:
- what you paid for your subscription in the 12 months before the claim;
- EUR 100.
12. Changes to these terms
We may update these terms, and we tell you in the app or by email before the changes take effect: at least 15 days before for coaches, and in good time for clients. If you don't agree, you can stop using Mealstone and delete your account before the change applies. Changes that the law or security requires may take effect sooner.
13. The App Store and Google Play
If you downloaded Mealstone from Apple's App Store:
- These terms are between you and us, not Apple. Apple isn't responsible for Mealstone or its content, and has no obligation to provide maintenance or support for it.
- If Mealstone fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund what you paid for the app, if anything. To the extent the law allows, Apple has no other warranty obligation for it.
- Apple isn't responsible for any claim about Mealstone, including:
- product liability;
- failing to meet a legal or regulatory requirement;
- consumer protection, privacy or data protection;
- infringing someone else's intellectual property. We handle these claims, not Apple.
- You confirm that you aren't in a country subject to a US government embargo, or on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries benefit from these terms and can enforce them against you.
If you downloaded Mealstone from Google Play, Google Play's terms apply to the download and to purchases there. Google isn't a party to these terms.
14. Complaints, disputes and law
- If something goes wrong, please write to support@fluttech.com first. We aim to reply within 14 days. Coaches can use the same address for complaints about a decision we made about their account or listing.
- These terms are governed by Romanian law. If you're a consumer living in another EU country, you also keep the protection of the mandatory laws of that country. You can bring a claim in the courts where you live, or in Romania.
- If you're a coach, the competent courts of Romania decide disputes about these terms.
- If you're a consumer in Romania, you can also turn to the National Authority for Consumer Protection (ANPC, anpc.ro), including its alternative dispute resolution service.
15. General
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- We may transfer these terms to another company if Mealstone is sold or reorganised. If we do, we tell you, and your rights under them stay the same.
